Terms and Conditions for domestic transport and postal services of BPS
1. These terms and conditions specify the principles of performing express and standard transport services and postal services rendered by Business Park Service Arkadiusz Jarząb, on the basis of the Act of 15 November 1984. Transport Act- consolidated text, Journal of Laws of 2000, no. 50 item 601 as amended, hereinafter called “Transport Law” with the ordinance MTiB concerning the status of consignment and complaints procedure of 24 February 2006. Journal of Laws of 2006 no. 38.266 and the Act of 23 November 2012 Postal Law hereinafter called “Postal Law”.
2. The principles of performing international road transport by BPS is specified in the Terms and Conditions of BPS service in the scope of international road transport.
3. The principles of performing international air transport by BPS is specified in the Terms and Conditions of BPS service in the scope of international air transport.
§2
For the purposes of these Terms and Conditions the following definitions shall apply:
Terms and Conditions – these Terms and Conditions.
BPS – Business Pack Service Arkadiusz Jarząb with registered office in Gdańsk, rendering services of parcel shipment including postal services.
Courier – BPS sub-contractor accepting the consignment in BPS system from the Sender and delivering it to the Recipient.
Bill of landing – document being the proof of concluding transport contract or postal delivery contract and for the delivery of the consignment.
Collection Point –premises where a person authorized by BPS company accepts the consignment from the Sender in order to perform the Service. The tasks and functions of a courier are applied accordingly to the collection point.
Sender – natural person, legal person or organizational unit without legal personality, who passes the consignment to a courier in order to perform a service.
Recipient – entity to which the consignment is to be delivered.
Price List – document, which specifies the weight and size of consignments with division into price categories of BPS services and specifies dates when these services are to be completed, and the amount of remuneration for BPS for the completed service.
Ordering party – natural person, legal person or organizational unit without legal personality, who orders BPS the service of transport or postal service. The ordering party can be the Sender, Recipient or the third party.
Service – Transport service or postal service performed by BPS.
Transport service – service performed by BPS, including collection, transport and delivery of shipments with contents other than mail, subject to regulations of the Transport Law.
Postal service – service including collection, sorting, transport and delivery of courier shipments, also these with mail, and for consumers- all shipments weighing up to 20 kg, subject to the Postal Law.
Shipment/Consignment – Postal shipment and shipment with goods, being subject of Services.
Consumer – natural person, who concluded contract for transport or postal service, with BPS for purposes not directly connected with business or professional activity.
Postal shipment – item with designation of addressee and address, submitted for acceptance or accepted by postal operator and delivered to addressee.
Shipment of goods – items accepted for transport on the basis of the bill of landing. Shipment of goods is not equivalent with postal shipment which is the subject of postal service in the understanding of Postal Law.
Undeliverable consignment – postal shipment which cannot be delivered to the Recipient or returned to the Sender due to lack of or erroneous address of the Sender.
Protocol – document describing the contravention of the Shipment, including damage or partial loss of the Shipment.
Postal Law – the Act of 23 November 2012 Postal Law (Journal of Laws 2012, item 1529).
Transport Law – the Act of 15 November 1984 Transport Law (consolidated text, Journal of Laws 2012 item 1173 as amended).
§3
1. The scope of BPS activity includes collection, transport and delivery of consignments to the value of PLN 100,000 on the territory of the country.
2. Services concerning consignments exceeding the value of PLN 50,000 can be performed after the conclusion of a separate contract with BPS.
3. The catalogue of postal services rendered by BPS include exclusively collection, sorting, transport and delivery of courier shipments in the understanding of the Postal Law, with exclusion of courier shipments with declared value in the understanding of the Postal Law. BPS does not provide mailing services for consignments other than courtier packages.
4. The catalogue of services rendered by BPS is defined below:
a) courier shipment- registered consignment containing mail or postal parcel, collected, sorted, transported and delivered in the manner, in general, ensuring:
- direct collection of postal consignment from the Sender’s place;
- postal consignments tracking from the moment of sending to the time of delivery;
- delivery of postal consignment in the guaranteed period specified in Terms and Conditions of postal services rendering or in the contracts for postal services rendering;
- delivery of postal consignment directly to the Recipient or person entitled to consignment collection;
- obtaining the receipt acknowledgement for postal consignment in writing or in electronic form.
- none of which exceeds 2000 mm, or
- which do not exceed 3000 mm for the sum of length and largest circumference measured in other direction than length.d) goods consignment- item accepted by BPS for transport on the basis of one bill of landing for the purposes of rendering transport service.
- in the Collection Point- when the Sender delivers the Parcel;
- at the Sender’s place- Parcel is collected by a courier, on the basis of the prior order.
- It is possible to order BPS courier services via the website.
- the declared value of the consignment;
- actual, ordinary value of the consignment;
- amount of PLN 150.00
